Imagine if you had a five year old, either boy or girl. They really want to have sex. That five year old is thirsty as hell. It's theoretically possible that the five year old actually does understand what sex is and all of the implications of it and could actually make true, informed consent. Society says no. Society says the five year old does not, as a matter of bright-line policy, have the capacity to consent. So under the South Korean legal system, yes, it is rape because he is deemed to not have the capacity to consent.
